dLCV believes that Virginia needs a state law protecting disability rights that is as strong or stronger than the Federal Americans with Disabilities Act. We have worked with the legislature for many years to achieve that goal. This year, two bills would help us move along that course, one of which is being treated favorably and one may be stalled.

  • HB 1800 (Cohen) – adds “public playgrounds” to the list of public places covered by the Virginians with Disabilities Act. The VDA states that someone with a disability has the same rights as other persons to the full and free use of many public places. The legislation makes clear that it includes public playgrounds. The bill was approved by the House Committee on General Laws and has been read in the full House. We expect to see the final passage of the bill on Monday or Tuesday. It will then go to the Senate for consideration.
  • HB 1680 (Cohen) includes “websites” in the definition of “place of public accommodation.” The VDA requires that a place of public accommodation must remove barriers to access when the removal is readily achievable. Although this is already required by federal law, the state-level protection bill is being opposed by banks and credit unions. The bill has been assigned to the House Committee on General Laws but has not been placed on any meeting agenda.
