Good news – the regulations to prohibit the use of seclusion and restraint in public schools are in the final phase of review!  For a summary of the regulations, click on the link to download our fact sheet below.

While there is always room for improvement, dLCV believes that the Board of Education should adopt these regulations so that we can begin to implement them across the Commonwealth.

The public comment period for this final round is from February 18th through April 19th.  The Board of Education will hold a public hearing on the regulations on 3/21/2019 at noon in the 22nd floor conference room of the James Monroe Building.  The site for the public hearing details is at http://www.townhall.virginia.gov/l/viewmeeting.cfm?meetingid=28969

Background

In 2015, the Virginia legislature passed a law directing the Virginia Board of Education to adopt regulations governing the use of seclusion and restraint.  Once finalized and adopted, these regulations will apply to all students and school personnel in Virginia’s public elementary and secondary schools.

School divisions are not required to use seclusion or restraint in their schools, but those that opt to do so will be required to follow the finalized and adopted regulations.
